Lending rules in Indiana

Payday lendingPermitted and regulated — maximum loan amount: The principal loan amount is at least $50 and not more than $550; maximum loan term: Not less than 14 days. Finance charges: (1) Finance charges on the first $250 of a small loan are limited to 15% of the principal. (2) Finance charges on the amount of a small loan greater than $250 and less than or equal to $400 are limited to 13% of the amount over $250 and less than or equal to $400. (3) Finance charges on the amount of the small loan greater than $400 and less than or equal to $550 are limited to 10% of the amount over $400 and less than or equal to $550. (4) The amount of $550 in subsection (3) is subject to change under the provisions on adjustment of dollar amounts (IC 24-4.5-1-106). Interest rate cap (usury limit)Usury limit: A person who, in exchange for the loan of any property, knowingly or intentionally receives or contracts to receive from another person any consideration, at a rate greater than two (2) times the rate specified in IC 24-4.5-3-508(2)(a)(i) [generally an APR exceeding 72%], commits loansharking. Finance rates and fees for licensed lenders: For non-real estate secured consumer loans, Maximum Daily Rates (exclusive of prepaid finace charges): The greater of 25% per annum OR a blended rate of 36% per annum on the portion not exceeding $2,000, 21% per annum on the portion between $2,000-$4,000, and 15% on the remainder exceeding $4,000. IC 24-4.5-3-508(2) In addition to the Maximum Daily Rate, a lender may contract for and collect prepaid finance charges.
